Swing21 Terms of Use

These Terms of Use are an agreement between you and DESTYLAT Team for the Swing21 app and swing21.com. They sit alongside Apple’s standard Licensed Application End User Licence Agreement for App Store downloads.

Agreement

By downloading, installing, or using Swing21, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the app.

These Terms are concluded between you and DESTYLAT Team only, not with Apple. DESTYLAT Team, not Apple, is responsible for Swing21 and its content.

These Terms must not conflict with the Apple Media Services Terms and Conditions. If they do, the Apple terms control for App Store distribution.

Apple’s role

Maintenance and support for Swing21 are DESTYLAT Team’s responsibility, not Apple’s. To the maximum extent permitted by law, Apple has no warranty obligation for Swing21. Any claims relating to the app (including product liability, failure to conform to legal requirements, and consumer-protection claims) are DESTYLAT Team’s responsibility, not Apple’s, except that these Terms do not limit liability beyond what applicable law allows.

If a third party claims that Swing21 or your use of it infringes intellectual property rights, DESTYLAT Team, not Apple, is responsible for investigating, defending, settling, and discharging that claim.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Refunds and App Store billing follow Apple’s rules. We do not replace Apple’s refund process.

Licence

DESTYLAT Team grants you a limited, non-exclusive, non-transferable licence to use Swing21 on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including Family Sharing or volume purchasing where Apple allows it.

You may not copy, reverse engineer (except where the law allows), rent, or redistribute the app except as Apple’s terms permit.

Not financial advice

Swing21 provides market analysis and heuristic screens (including labels such as Watch, Pass, Overweight, and Underweight). It does not provide financial, investment, tax, or legal advice. It does not instruct you to buy, sell, or trade. Nothing in the app is an offer of securities or a recommendation to transact.

Crypto markets are volatile. Past patterns and paper results are not indicative of future results. You are solely responsible for your decisions.

Paper basket

Any paper basket, notional, or track record in Swing21 is hypothetical and on-device. It is not a brokerage account, deposit, credit, or claim on real assets. There is no real-money execution, custody, or order routing in this version.

Market data

Prices, volumes, market caps, and derived scores come from third-party sources and on-device calculations. Data may be delayed, incomplete, or wrong. We do not warrant accuracy or availability.

Acceptable use

You may use Swing21 only for lawful personal or internal purposes. You must not misuse the app, attempt to disrupt our or third-party services, or use it to provide regulated brokerage or advice to others as if it were a licensed product.

Intellectual property

Swing21, including its name, icon, and software, is owned by DESTYLAT LTD or its licensors. Third-party names (for example Apple, Kraken, CoinGecko) remain their owners’ marks.

Disclaimer of warranties

Swing21 is provided “as is” and “as available.” To the maximum extent permitted by law, DESTYLAT Team disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers; in those places, they apply only to the extent permitted. This does not affect mandatory consumer guarantees (for example under the New Zealand Consumer Guarantees Act 1993 or equivalent laws).

If Swing21 fails to conform to any applicable warranty that cannot be disclaimed, you may notify Apple, and Apple may refund the App Store purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.

Limitation of liability

To the maximum extent permitted by law, DESTYLAT Team is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or trading losses, arising from use of Swing21 or reliance on its analysis.

Where liability cannot be excluded, our aggregate liability arising from Swing21 is limited to the greater of the amount you paid for the app (if any) in the 12 months before the claim and NZ$50, except where applicable law requires otherwise (including for death, personal injury, or fraud).

Third-party terms

You must comply with third-party terms that apply to your use of Swing21, including Apple’s terms, your wireless carrier’s terms, and the terms of market-data providers you access through the app (such as Kraken and CoinGecko).

Legal compliance

You represent that you are not located in a region subject to a U.S. Government embargo or designated as a “terrorist supporting” region, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Termination

These Terms apply until terminated. Your rights end if you fail to comply. You may stop using and delete the app at any time. We may stop offering Swing21 or change it without liability, subject to mandatory law.

Governing law

These Terms are governed by the laws of New Zealand, without regard to conflict-of-law rules. Courts of New Zealand have non-exclusive jurisdiction, except that you may have mandatory rights to bring claims in your country of residence (for example in the EEA, UK, or Australia).

If a provision is unenforceable, the rest remains in effect. We may update these Terms; the Updated date will change. Material changes may be notified in-app or on this site.
